Trading Standards

For Businesses

Trading Standards investigations can cover a wide range of potential offences that include copyright, trademarks, trade descriptions, consumer credit, weights and measures and food safety, among others.

The consequences of a contravention of this legislation can be very significant. Penalties can range from a formal caution to a substantial fine and even a period of imprisonment. The potential for damage to reputation is great and this may cause a company further loss, over and above any financial penalties that have been imposed. It is therefore essential that all businesses take a proactive stance in this area.

If you are subject to a Trading Standards investigation Saunders Solicitors can be on hand, at short notice, to offer guidance from the initial interview under caution. Where possible, representations are made with the aim of ensuring that the matter is discontinued at an early stage. In the event of a prosecution Saunders Solicitors will assess the evidence and advise you on the appropriate plea, taking all the necessary proactive steps to defend the case. We can also advise on other matters relevant to the case, for example confiscation proceedings following a guilty plea or finding of guilt and also in relation to any applications that may be made by Trading Standards for the forfeiture and destruction of any goods seized.

Within our highly regarded regulatory team, we provide clear, practical and commercially considered advice to help our clients at all stages of investigation and prosecution.
